And such wonderful evidence such as:
- I wasn't hired
- The guy hired was younger than me
- Therefore, I am a victim of age discrimination
But, for some people , EVERYTHING is always someone else's fault.

since most of us do not really know all the details of this case it is all speculation so OG is not going to speculate..I suspect they just didn't want him back but they did a poor job concealing that fact...but without more info that is all that I can add...

The Salem News has 4 links (at the bottom) to many of the court documents involved in this case. And while I normally would agree with you about "we really don't know all the facts... thus how can I judge," the documents seem to give some insight into this situation... and frankly, Niz's past behavior and attitude is well known throughout the City.
In this case, I think he was not rehired because he had embarrassed the entire Peabody program and it was time for a change.

if that indeed was the City's position then how is that reason defended if he claims discrimination as he now has?? Do we know if Niz was ever told by Larking or Binkley why he was not hired? How does the city now defend against discrimination if his personnel is clean as a whistle ?? Can the city defend its decision not to rehire him? OG says no !!
Wouldn't it be interesting to see who would have been hired as coach if the only thing they could have seen were the qualifications of each candidate without any knowledge of the candidates names? Do you think that Niz's resume would be the one picked? I do. Niz was doomed because he is Niz, plain and simple.
The City, or anyone, doesn't need a reason to not hire anyone. You simply say, "we are not hiring you" and be done with it.
Anything more said simply provides fodder for 'potential problems' later.
No one is guaranteed a job. Nor is anyone guaranteed to be continued in their job. Even with perfect attendance and evaluation scores. You serve at the pleasure of your superiors... under the guidelines of a contract (if any) exists, and the protection of employment law.
And as a representative of the Peabody school system, he would be subject to an even hirer level of scrutiny for his actions (or inactions) in the performance of his duties.
I think that the City will be found clean in this instance... but they may just decide to plead it out if it looks like it might turn into another Brody-type nightmare of years and years in the court system.

surely Niz asked "why didn't I get the job?" NONE of us know how Larkin and/or Binkley directly answered that question for him...if they said that a 'more qualified candidate was selected' then that is a crock..therein lies the mystery.
Having been in the business world for too long let me tell you this...
If ANYONE ever answers that question... "Why didn't I get the job?" from a failed applicant... They themselves should be fired.
The realities of this litigious society make answering that question the basis of too many potential legal actions against the company (or City).
The correct answer is...
"Thank you for applying for this position. The position has now been filled."
If they didn't know that then they are NOT management material and should be looking for a different line of work where they do NOT need to manage people... or the ramifications of their actions.

ok....so we are talking about a 'green' high school principal who may not have been as business savvy as you suggest...so now with the legal issue doesn't the city need to be able to justify why Niz was not hired? don't they need to provide some objective basis of candidate rankings? and if nothing 'negative' is found in Niz's personnel files to support the fact that he was not selected then what happens?
